Affirming.

Prior to May, 1894, H. D. Burnett & Son conducted a general merchandising business in Laurel county, Kentucky. The appellant, J. M. Robinson, Norton & Company, wholesale merchants, from which the firm bought goods, being1 unable to collect an account, obtained' a judgment for a balance. This judgment was unsatisfied and on April 25, 1895, execution was issued and levied upon two small tracts of land in Laurel county, belonging to H. D. Burnett, and at the sheriff’s sale, the appellant, J. M. Robinson, Norton & Company, became the purchaser.
