Plaintiff brought action against the defendant to recover damages in the sum of $3,000 occasioned by alleged neglect of duty and misconduct of a train porter while on duty on the Great Northern train No. 4, on which train the plaintiff was a passenger from Minot to Fargo. She alleges, among other things, that while engaged in rid ing on the said train she was approached by the colored porter in charge of the coach and by him insulted and attacked and she was so continuously insulted on said passage during the afternoon and evening •of that trip that she became very frightened and ill and…
