—In an action, inter alia, for a judgment declaring the rights of the parties with respect to a certain easement, the defendant West Branch Conservation Association, Inc. appeals from so much of an order of the Supreme Court, Rockland County (Bergerman, J.), dated March 20, 1996, as denied that branch of its cross motion which was to dismiss the complaint insofar as asserted against it.

Ordered that the order is affirmed, insofar as appealed from, with costs.
