The plaintiff, who is appellee here, had judgment below on an obligation of the appellant (hereinafter referred to as the defendant), which was evidenced by the following writing: “Montgomery, Ala., Aug. 27th, 1887. I have received from Mr. A. Ohlander a relinquishment to his lease with L.
