These are actions of the case for negligence. The plaintiff, Maybelle Faubert, seeks to recover for personal injuries sustained by her when she fell on the floor in defendant’s department store, and her husband, Charles Faubert, seeks consequential damages resulting from these injuries to his wife. Both cases were tried together in the superior court and, at the conclusion of the evidence, the trial justice granted the defendant’s motion in each case for a directed verdict in its favor.
