The defendant in error (hereafter called the “plaintiff”) sued the plaintiff in error (hereafter called the "defendant”) for the recovery of a deposit of $3,000 made in the defendant hank by the First National Bank of Macon, Ga., of which hank the plaintiff has been duly appointed agent under the provisions of the national banking act. There ivas a trial by jury. At the con*340elusion of the testimony counsel for each party asked the court for direction of verdict in favor of such party.
