The Athens Mutual Insurance Company issued to M. G. Toney a policy of insurance covering a dwelling-house occupied by a tenant, which contained the following clause: “This entire policy, unless otherwise provided by agreement endorsed hereon or added hereto, shall be void, . . if a building herein' described, whether intended for occupancy by owner or tenant, be or become vacant or unoccupied and so remain for ten days.” The undisputed evidence was, that one tenant moved out of the house on December 7, 1905, and that another tenant moved in on January 6, 1906, and that the house was vacant…
