Appeal from the Superior Court of Cook county; the Hon. Parren Q. Barr, Judge, presiding. John B. Mayer, a resident of Chicago, died June 3, 1892, leaving him surviving his widow, Veronicka Mayer, and his daughter, Anna Mayer, as his only heirs-at-law. He left a will, which was on June 20, 1892, admitted to probate by the probate court of Cook county. The first clause of his will directed the payment of his debts and funeral expenses.

Appellant McCracken first contends that the trial court erred in overruling the demurrer filed by both appellants to the bill in the superior court in what is termed the main cause, and also in overruling the two joint and several pleas filed to the same bill on September 30, 1908. They did not elect to stand by their demurrer but filed their pleas to the bill, and cannot now complain of the action of the court in overruling the demurrer.
