This civil action was brought by Sandra Peryea, individually and as mother and next friend of Michelle Peryea, a minor, against Coca-Cola Bottling Company of New England. The complaint is in two counts. Count I alleges that the plaintiffs sustained personal injuries as a result of the defendant’s negligence in the manufacture and packaging of Coca-Cola. Count II alleges that the plaintiffs’ injuries resulted from a breach of implied warranty of fitness of the defendant’s product for human consumption.
