This is an action of ejectment commenced in the circuit court of Milwaukee county, by town against the city, to recover possession of forty acres 0 J , J land, situate within the present limits of tlie city. Tire town r was organized by act of the legislature of the territory of Wisconsin, approved January 3d, 1838. On the 31st of January, 1846, a portion of the town was set off and incorporated into the city.
