Lake Oliver, plaintiff in error, was charged with having committed an assault, with intent to kill, upon Henry C. Fiolle, by means of a deadly weapon, on October 2, 1918. By a verdict of the jury rendered on September 1, 1920, he was found guilty as charged and his punishment fixed at confinement in the state penitentiary for a period of one year and' three months. From the judgment on this verdict he appeals to this court.
