The United States Department of Labor and its Secretary appeal from an order of the district court granting attorneys’ fees to Rapid Robert’s, Inc. as a result of the district court setting aside an order of the Secretary of the United States Department of Labor assessing penalties against Rapid Robert’s for violation of the Employee Polygraph Protection Act, 29 U.S.C. §§ 2001-2009 (1988), and implementing regulations.
