Appeal from that part of an order of the Supreme Court at Special Term (Grow, J.), entered March 20, 1985, in St. Lawrence County, which treated defendant’s motion to dismiss the complaint as a motion for summary judgment and denied the same with respect to plaintiffs first cause of action.
