During the spring of 1913, appellant; an Indiana corporation, was engaged in the construction of a reservoir just north of the city of Austin, which required the employment of a large number of men. In the course of said work it became necessary to refill the excavation made for the foundation of said reservoir with concrete, and to erect concrete walls thereon above the surface.
