Error from Osage district court. Foreclosure, brought by the bank, as plaintiff, against Pratt and wife. At the November term, 1873, the plaintiff had judgment against Pratt for $3,065.18, and a decree against Pratt and wife for the sale of certain lands.

Two grounds of error are alleged in the petition in error: First, that the court erred in overruling the demurrer to the petition; and, second, that the findings were not sustained by the evidence, and were contrary to law. Of course, then, our inquiry will be limited to these two matters. The question raised by the demurrer is this: The action was on a note and mortgage payable to the'order of W. F. Aderhold. The petition alleges that said Aderhold “indorsed, transferred, and delivered the said promissory note and mortgage to JohnR,. Mulvane, cashier of the said plaintiff.” It…
