Affirming.

Winright Adkins owned a tract of land consisting of of about one hundred and forty-four acres, on Greasy Creek, in Pike county, upon which he resided, in 1885. His wife, Nancy Adkins, and his sons, L. G. or Grant Adkins and William Adkins, resided with him. L. G. Adkins was' his youngest child, at that time, and was twenty or twenty-one years of age. Winright Adkins had been married, previous to his marriage with Nancy, and by his first marriage there were five children.
