DECISION

This case is an appeal from a February 28, 1995 decision of the Coastal Resource Management Council (Council) designating a portion of land owned by the plaintiffs as a public right of way. Jurisdiction is pursuant to G.L. 1956 (1993 Reenactment) §42-35-15.

Facts/Travel

The present appeal concerns the Council's attempt to designate a portion of the Buonomanos' land as a public right of way. The subject portion, approximately 10 feet in width and 90 feet in length, is an "L" shaped path following the contours between lots 22 and 23 on Tax Assessor's Plat No. 369 in Warwick, Rhode Island.…
