OPINION AND ORDER

DAN M. RUSSELL, Jr., Chief Judge.

This action was commenced on March 4, 1963, by ten minor school age children against the School District. The Plaintiffs alleged that they suffered irreparable injury by the operation of a compulsory biracial school system by the School District. The first few years of litigation in this case were characterized by district court judgments in favor of the School District, followed by reversals of those judgments by the United States Court of Appeals for the Fifth Circuit.
