MEMORANDUM OPINION

DENNEY, District Judge.

This action came on for trial before the Court on agreement of the parties that both civil cases be consolidated for trial, since they both involve the same parties and issues. The plaintiff, Chicago and Northwestern Railway Company [Northwestern], seeks to recover from the defendant, Union Packing Company [Union Packing], demurrage charges al*1306legedly due as a result of the detention of refrigerated trailers beyond the free time provided in the applicable tariff.
