Defendant was charged in a one-count indictment with possession with intent to distribute phencyclidine (commonly known as “PCP” or “angel dust”) in violation of 21 U.S.C. § 841(a)(1). The indictment was based upon items seized in a search of a single-family dwelling in Bloomington, Minnesota, under a search warrant issued by the state district court. The warrant was authorized by a state district judge, based upon the affidavit of a Minneapolis police officer.
