Appeal from an order of the Supreme Court (Relihan, Jr., J.), entered September 28, 1998 in Tompkins County, which, inter alia, denied defendant’s motion for summary judgment dismissing the complaint.

Plaintiff was injured when he slipped and fell on the floor of the gymnasium at defendant’s college. After playing intramural *607basketball, he left the court at halftime to take a break.
