In this consolidated action to recover damages for personal injuries, third-party defendant D. Reiner, Inc. (hereinafter Reiner), moves for summary judgment against plaintiff Elliot Maddox (hereinafter Maddox) and third-party plaintiff the City of New York (hereinafter the City).
