A very accurate and elaborate statement of the material facts in this case will be found in the opinion of the Court of Civil Appeals in 68 S. W. (2d) 1077. As we are of the opinion, after a careful consideration of the case, that the conclusion reached by the Court of Civil Appeals is correct, we *575do not think it necessary to make an extended statement of the facts here, or to discuss all of the questions considered by the Court of Civil Appeals.
