*1798Appeal from an order and judgment (one paper) of the Supreme Court, Monroe County (Evelyn Frazee, J.), entered September 8, 2009 in a proceeding pursuant to CPLR article 75. The order and judgment vacated an arbitration award.
It is hereby ordered that the order and judgment so appealed from is unanimously reversed on the law without costs, the petition is denied, the application is granted and the arbitration award is confirmed.
