HALL, District Judge.

The defendants Edwin P. Russell, Porter Tremain. and Augustus Tremain, were adjudged bankrupts on the 6th of January, 186S; and the plaintiff was soon after appointed their assignee. These defendants had been copartners in business, and, on the 5th of December, 1806, were indebted to the other defendant, the bank, in the sum of $43,000. This indebtedness was evidenced by sundry notes of the firm, as maker. Each of these notes of the firm bore the endorsement of one of the co-partners.
