ERROR to the common pleas of Dauphin county. Eli K. Price, administrator de bonis non cum testamento annexo of the Hon. William Tilghman, deceased, against George Fisher, Esq. This was an action of debt on two bonds dated the 26th May 1814, conditioned for the payment of 670 dollars 67 cents on the 1st of April 1S16, and the same sum on the 1st of April 1817, and the action was brought on the 24th of June 1837. This action, as it appears, was commenced in the court below, by suing out the original writ for that purpose, on the 24th of June 1837, in order to recover the amount of moneys alleged to be due on two bonds, dated the 26th of May 1814, and given by the defendant to the Hon. William Tilghman in his lifetime, each for the payment of 6'70 dollars and 67 cents: one payable .on the 1st of April 1816, and the other on the 1st of April 1S17.
