Appeal from a judgment of the County Court of Ulster County (Bruhn, J.), rendered March 20, 2006, convicting defendant upon his plea of guilty of the crime of burglary in the first degree.

Defendant and two codefendants were charged in an indictment with burglary in the first degree, robbery in the first degree and assault in the second degree. The charges arose from an incident during which defendant and his codefendants unlawfully entered the home of defendant’s former employer, who was approximately 80 years old, and then assaulted and robbed her.
