This is an appeal by appellant Bank from the condemnation of an airplane by the state under the forfeiture provisions of OCGA § 16-13-49 (Code Ann. § 79A-828).
Georgia law enforcement officers seized a Cessna 402 airplane which was carrying a cargo of marijuana. An action for condemnation of the plane was filed in accordance with OCGA § 16-13-49(e) (Code Ann. § 79A-828), supra. Notice by publication was made. Bob Absher Motors of Trenton, Florida, was believed to be the owner of the plane. Absher did not answer but appellant Bank did as an intervening claimant…
