The plaintiff, as administrator cum testamento, brings this action: to determine adverse claims to real property described as the East fifty feet (50') of the North fifty feet (50') of Lot four (4), Block five (5), Northern Pacific Addition to the city of Bismarck; to quiet title to said property in the plaintiff as administrator of the estate of Frank Tousley, deceased; to have all claims of the defendant'to said property adjudged null and void; and to recover from the defendant “the reasonable value of the rents and profits and use and occupation of the said premises . . . .”
