This action was filed by the appellant, United States Trust Company, assignee of the Louisville Property Company, against the appellees, H. M. Frakes, German Methodist Orphans Home and the Board of Missions and Church Extension of the Methodist Episcopal Church, to enjoin the cutting of timber and for the value of timber cut and removed from the land described in the petition.
