Jennifer Jill Whitehead was tried and convicted by an Anderson County jury 1 for the capital murder of Emma Whitehead, an individual under the age of six, 2 and for injury to a child. 3 Whitehead was sentenced to life without parole on her capital murder conviction and to fifteen years’ incarceration on her injury to a child conviction. Whitehead appeals her convictions claiming (1) that the State’s closing argument referenced her failure to testify in violation of the United States Constitution, the Texas Constitution, and the Texas Code of Criminal Procedure…
