—Judgment, Supreme Court, Bronx County (David Stadtmauer, J.), rendered April 13, 1999, convicting defendant, after a jury trial, of criminal sale of a controlled substance in or near school grounds, and sentencing him, as a second felony offender, to a term of 7V2 to 15 years, unanimously affirmed.

The verdict was based on legally sufficient evidence and was not against the weight of the evidence. Even if we were to review defendant’s unpreserved claim that the evidence failed to prove that the sale occurred on school grounds, we would find that the record clearly established that the sale…
