APPEAL FROM THE CIRCUIT COURT OF THE UNITED STATES FOR THE EASTERN DISTRICT OF WISCONSIN. This was an appeal from the Circuit Court for the Eastern District of Wisconsin. In accordance with the opinion of the presiding justice a decree was made setting aside the assessment of the tax and enjoining the city and its officers from collecting it.
We are of opinion that both this court and the Supreme Court of Wisconsin are committed to a contrary doctrine.
