COLINS, Judge.

Raymond D. Morningstar (Morningstar) petitions for review of the April BO, 199B order of the State Civil Service Commission (Commission) granting the Department of Transportation’s (Department) motion to dismiss. For the reasons set forth herein, we affirm the Commission’s order.
