This action in equity was instituted by John S. Rogers and others claiming to constitute the entire membership of an organized body of Christians known as the! Salem Baptist Church, against- the appellees, William M. Rogers and others, for the purpose of determining the right as between these parties to the use of the church property for divine worship. The church property is located near Walton in Boone County and has been used by this body of Christians as a place of worship since the year 1825.
