JAMES, O. J.

[1] This action was instituted in the justice’s court; the justice’s transcript showing, “Suit upon contract for $185.00.” In the county court, on appeal from the justice’s judgment, written pleadings were filed, and plaintiff declared for damages in the sum of $185 for breach of a contract. This, by appellant’s first assignment of error, is claimed to have been setting up a different cause of action. We overrule this, a® we conclude that the general designation of the justice’s transcript was broad enough to include any suit based on a contract.
