On the 14th day of May, 1900, after due notice, the plaintiffs moved before this Court to dismiss the appeal which had been taken by the defendants from a judgment rendered in plaintiff’s favor at a trial had before Judge Ernest Gary and a jury of the above stated action, had in the Court of Common Pleas for the county of Charleston, in said State, during the spring term of the year 1900, on the ground that the notice of such appeal had not been served within the ten days next succeeding the adjournment sine die of said term of said Court, which…
