delivered the opinion of the court:

Plaintiff, Pick Fisheries, Inc., brought an action for damages against defendant, Bums Electronic Security Services, Inc., upon an amended complaint containing a count in tort and one. in contract. Plaintiff moved to strike the affirmative defense asserted by defendant that its liability was limited by a provision in their contract. Plaintiff appeals from the order denying the motion. The issue on appeal is whether the contract clause which purports to limit defendant’s liability for damages is valid and enforceable.
