This suit was brought by appellants the Farmers’ State Guaranty Bank of Navasota, Tex., now defunct, and James Shaw, the commissioner of banking of Texas, as statutory receiver of said bank, against appellee, Clarence S. Cone, Jr., an employee of the bank, to recover damages for the alleged faithlessness of said Cone as an agent of the bank, and against said employee, as principal, and appellee American Surety Company, as surety, to recover the sum of $2,500 on a $2,500 fidelity bond given to the bank to secure the bank against specified defaults of the said Cone.
