In an action to recover damages for personal injuries, the defendant Brooklyn Indoor Sports Center, Inc., appeals from an *778order of the Supreme Court, Kings County (Battaglia, J.), dated April 8, 2008, which denied its motion for summary judgment dismissing the complaint insofar as asserted against it.

Ordered that the order is affirmed, with costs.
