Dunham-Bush, Inc. (“Dunham-Bush”), a manufacturer and seller of low pressure steam heating equipment under the registered trademark “Vari-Vae,” commenced this action upon claims of breach of contract, unfair competition, tortious interference with business relationships and patent infringement, alleging that the defendants conspired to manufacture and sell a copy of Dunham-Bush’s “Vari-Vac” heating system.
