This appeal concerns a checking account and the mutual rights and liabilities of the bank and its depositor which arise from it. As the circumstances are such that provisions of the Uniform Commercial Code 1 on the subject are inapplicable we look to the common law. At stake is almost a quarter of a million dollars paid by the bank and charged against funds standing to the credit of the depositor.
