Appellant, by and through her mother as next friend, appeals from the decision of the district court affirming the decision of the Secretary of Health and Human Services denying her application for child’s insurance benefits under section 202(d)(1) of the Social Security Act as amended, 42 U.S.C. § 402(d)(1). Appellant argues that: (1) the Alabama intestacy scheme is unconstitutional as applied to her and (2) but for its unconstitutionality she would be entitled to child’s benefits under 42 U.S.C. § 416(h)(2)(A). 1 This provision entitles children born out of wedlock to…
