delivered the opinion of the court;

*62.The eighteenth general assembly passed an act entitled, “An act in relation to courts of review.” The first section establishes a court to be known as the “court of appeals,” which shall exist for a period of four years from the date upon which the act took effect, and provides for the' number, qualifications, compensation and appointment of the judges, the filling of vacancies and the terms of the court.
