The appellant, an employee of the respondent, brought this action for the recovery of damages alleged to have been sustained by him on July 15, 1933, while working in the dairy of the respondent. The plaintiff in his testimony detailed the facts and circumstances surrounding the accident. His testimony tends to show that (on the day of the accident), he had been working in the dairy only about thirty minutes or a little longer before the accident occurred.
