The indictment charged appellant with the robbery of Joseph Sea-gall, by assault and violence and putting him in fear of life and bodily injury, on the 17th day of November, 1898. Joseph Seagall was an Assyrian by birth, about 18 years old; was a peddler, and had been in Texas only some seventeen months. Appellant was convicted of robbery, and his punishment assessed at confinement in the penitentiary fbr a term of five years.
