Under the complaint as amended in the court, below, Clyde Casey, plaintiff, brought his action against Southern Finance Company, defendant, to recover the sum of $55, with interest thereon accrued, for money had and received, as set forth in count B ‘of the amended complaint.
The only evidence offered upon the trial of this ease was that of the plaintiff himself.
