Appeal from Shelby Circuit Court. Heard before Hon. John Pelham. Ed Jackson ivas convicted of murder in the first degree and he appeals.

The defendant was indicted and tried for the murder of Janies Wright. He was convicted of murder in the first degree and sentenced to imprisonment in the penitentiary for life. The undisputed evidence showed that the said James Wright was killed in Acton, Shelby county, in house No. 158. This house belonged to the Alabama Fuel & Iron Company, a corporation. Dynamite was exploded under this house (No. 158) and as a result thereof the said James Wright was killed. He and a man by the name of Tom Hudson were asleep in the house at the time of the explosion. There was, at the time, a strike among…
