OPINION AND ORDER SUMMARILY DISMISSING PLAINTIFF’S COMPLAINT

LAWSON, District Judge.

Plaintiff, D. Samuel Goodell, presently-confined at the Pine River Correctional Facility in St. Louis, Michigan, has filed a pro se civil rights complaint, pursuant to 42 U.S.C. § 1983. The defendant is a fellow inmate, and also is plaintiffs cell mate. 1 The plaintiff alleges that the defendant planted contraband in the bunk of a third cell mate and made a false misconduct report, resulting in confiscation of plaintiffs materials which he needed to file legal papers in state court.
