GODBOLD, Circuit Judge:

Defendant Milgo appeals from the district court’s order of summary judgment against it as to some of its counterclaims. We conclude that we lack jurisdiction to hear an appeal from this order.

I. Facts

Both Milgo and Western Electric1 manufacture terminal equipment known as data modems. “Modem” is an acronym for “modulation and demodulation.”2 Modems, when connected to telephone lines, allow computers to send and receive information to and from each other.
